By placing a reservation with Lush Transportation you acknowledge and agree to the following policies and terms and conditions.
In order to reserve your car service, we require a 25% deposit at the time of booking. This deposit is non-refundable and non-transferrable. We accept cash and all major credit cards (American Express, Discover, MasterCard, & Visa).
The final payment of your balance must be paid by the service date. Lush Transportation accepts cash and all major credit cards (American Express, Discover, MasterCard, & Visa).
All overtime is to be paid directly to the chauffeur in CASH ONLY on the day of service before the car goes into overtime status. Overtime is charged in 1-hour increments. You can find the overtime rate pertaining to the vehicle you reserved on the front of your contract.
Lush Transportation requires that all changes be received by phone 4 hours prior to scheduled pick-up time. If a change cannot be accommodated and results in a cancellation, the client will be charged for the full fare. Changes to itinerary can only be done by the individual that made the reservation.
At Lush Transportation, all flight arrival times are updated in real time. Our information is only as reliable as the information provided by the airlines and airports. Wait time will start 30-minutes past the last posted flight arrival time or at a time otherwise designated by the Lush dispatcher. Wait time will be billed at the hourly rate of the vehicle that was reserved plus any additional charges.
For all point-to-point reservations there is a 15-minute grace period from the scheduled pick-up time. Wait time charges will begin once that 15-minute grace period has past or at a time designated by the Lush dispatcher. Wait time will be billed at the hourly rate of the vehicle that was reserved plus any additional charges.
In the event that you need to cancel your reservation, you will need to call our office to let us know of the cancellation. Only the person that made the reservation can cancel it. Cancellation may be made up to 8 hours prior to scheduled pick-up time.
As long as the cancellation occurs within the time frame above there will be no further penalty to you except for the forfeiture of the initial deposit. In the event that cancellation of your service occurs after the time specified above, you will be responsible for the remaining balance due. The balance will be automatically charged to the credit card that was given at the time of placing the reservation. Please note that deposits and payments previously made are non-refundable and non-transferable.
The client understands and accepts that Acts of God, unforeseen traffic, road conditions and/or severe weather conditions delay travel. Every effort will be made to dispatch the contracted vehicle(s) during these conditions and all attempts will be made to arrive at the designated pick-up location on time. In the event that there is a delay caused by an Act of God, unforeseen traffic, road conditions and/or severe weather conditions resulting in any of the contracted vehicle(s) arriving late at any of the pick-up locations, we will modify the drop-off time to reflect the amount of time caused by the delay. You agree that this action will compensate you for the delay and there will be no further liability to us. Should we deem at any time up until the day of the service that said conditions are too dangerous for our chauffeurs and/or vehicle(s) than we will inform you of such and terminate the service. You will receive a full refund of any payments made.
The chauffeur inspects each vehicle before, during and after each rental. The client is responsible for all damages or cleaning charges incurred by the client or party of the client committed during service, either willfully or accidentally. Client will be charged to extent of the actual cost to repair or replace.
Client agrees that there will be NO SMOKING or EATING in our vehicle(s). Client agrees that no illegal drugs or alcoholic beverages will be consumed on our vehicle(s). NARCOTICS OR CONTROLLED SUBSTANCES ARE PROHIBITED AND WILL RESULT IN IMMEDIATE TERMINATION OF THE SERVICE.
The client hereby agrees to hold Lush Transportation, its agents and employees harmless from any consequences of such wrongful use by client or client’s guests, including the cost to defend against the same. Chauffeur has the right to terminate the trip, without refund, if he/she feels that the party is not abiding by the above rules or is putting the vehicle or the chauffeur at risk.
Lush Transportation follows all CDC (Centers for Disease Control and Prevention) guidelines pertaining to COVID-19.
We have taken enhanced health and safety measures for our passengers and employees.
By reserving a vehicle with Lush Transportation, you voluntarily assume all risks related to exposure to COVID-19.
Lush Transportation, or its designated representative, is hereby appointed client's attorney-in-fact to sign client's signature for additional charges to client’s credit card for damages, overtime, and/or any changes due & not immediately paid by the client and is expressly empowered and authorized to charge all costs resulting from damages to said credit card.
Except in the case of willful misconduct or gross negligence of Lush Transportation, its agents or employees, client hereby waives any and all claims against Lush Transportation, its agents or employees for injury, loss, or damage, including consequential damages, to client's person or property from whatever cause. In addition, client waives any right of subrogation with regard to the same.
Neither Lush Transportation, its agents or employees shall not be liable for any personal property of the client or client's guests, which are misplaced, damaged or left in the vehicle. Lush Transportation reserves the right to institute and establish rules and regulations of guest conduct, which may be amended from time to time, including termination of rental, without refund, due to non-compliant guest conduct.
In the event of a vehicle breakdown, all efforts will be made to supply a replacement vehicle. If a replacement vehicle is sent and/or client refuses a replacement vehicle, no refund is due. If no replacement vehicle is available, refund will be issued with no further liability to us. In case of an emergency, Lush Transportation may subcontract his rental to another car service.
